1.0. INTRODUCTION

These terms and conditions do not affect your statutory rights as a consumer. Your statutory rights are not excluded or limited in any way, in accordance with the Sale of Goods Act 1979 (as amended).

By viewing and/or purchasing from the ideas4writers website (ideas4writers.com) you are entering into a legally binding contract. You are deemed to have accepted the following terms and condition, as set out below and in the separate data protection/privacy policy. Please contact us if you do not agree to be legally bound by these terms. Please also contact us if you have any questions regarding terms of use. We will be pleased to assist you with your query.

ideas4writers may change these terms and conditions at any time. We will post any changes online. Certain provisions may be superseded by expressly designated legal notices or by terms located on particular pages of this website. (For example, certain product warranties.)

We have a policy of continuous product development. We reserve the right to amend the specifications of any product without prior notice in relation to future sales. This includes adjustments to size, formatting and content of individual items purchased. Please email or call ahead to check exact sizes or potential changes.

Products supplied may differ, as a consequence, from those on display or advertised. In particular, the size may vary by a few millimetres from that stated in the product description. Unless agreed with you, the products supplied will be of equivalent value, functionality and appearance.

2.0. ORDERING FROM US

You are deemed to have placed an order with us by ordering via our online checkout process. As part of the checkout process, you will be given the opportunity to review your order and correct any errors. Once completed, we will send an order acknowledgment to the email address you provided during the ordering process. This will detail the products you have ordered and the price you have paid. ideas4writers will only accept your order upon despatch of the goods, even if your payment was processed immediately. We will notify you by email if we cannot accept your order or if you cancel the order prior to despatch.

2.1. We may refuse to accept an order:

(a) Where the goods are not available

(b) Where we cannot obtain authorisation for your payment

(c) If there has been a pricing or description error

(d) If you do not meet any eligibility criteria set out in our terms and conditions

(e) If you refuse to provide requested proof of identity where it is required to confirm your address/payment method.

3.0. PRICING

3.1. Should an incorrect price be displayed, we reserve the right to refuse your order. This is set out in ‘Ordering From Us’ (above).

3.2. All prices quoted are only valid at the time of contract. They are exclusive of any other matters unless otherwise agreed, and may be changed at any time.

3.3. We reserve the right to revise the quoted price in the event of unforeseen/extraordinary expenses appertaining to the supply of the goods.

3.4. VAT

Our annual turnover is currently below the UK threshold for VAT. We are therefore not registered for VAT, and consequently, do not add VAT to our prices. We reserve the right to add VAT to our prices if/when our turnover reaches the UK threshold.

4.0. DELIVERY

4.1. Delivery is deemed to be successful once the products have arrived at the address provided for delivery.

4.2. Signatures are not necessarily required as proof of delivery

4.3. If a signature is required you should check the number of cartons and the condition of the contents before signing. Should there be any shortages or damages, you should notify us by email within 1 working day of delivery. Our email address for these notifications is mail@ideas4writers.com.

4.4. Other products may be left at the recipient’s address without a signature. (Unless the customer has specified that it must not be left in their absence.) If this option is requested, and goods are left unsupervised, ideas4writers will not accept liability for the goods.

4.5. Once delivered, responsibility for the goods is deemed to be the customer’s. Any loss or damage to the product is then at your own risk. This is particularly notable when deliveries are made to public/work places where the signature of any authorised body is deemed to be proof of delivery.

4.6. ideas4writers will not accept any liability for late delivery of the goods. Delivery time will not be of the essence of the contract.

4.7. ideas4writers will not accept liability for non-delivery where this is caused by circumstances beyond its control.

4.8. If a delivery is refused or aborted at the delivery address, we have the right to charge for a second delivery. Our delivery obligation only stands for the first delivery attempt.

4.9. In all cases, we strive to deliver goods within 28 days from the date of the order. If it is apparent at the time of the order that delivery will take longer than this, we will advise you before accepting the order

5.0. REFUSAL OF DELIVERY

If you refuse delivery, you will be subject to a return delivery fee deemed reasonable in accordance with the order. These fees will be deducted from the refund amount. Your refund will be issued once the goods have been returned to us and fully inspected.

6.0. CANCELLATION AND RETURNS POLICY

We aim to offer a no-hassle returns policy.

6.1. General Cancellation and Returns Information:

These general terms and conditions apply to all purchases from the ideas4writers website, telephone sales, and in-person sales. (Unless specifically expressed in the product-specific return as laid out below.)

6.2. If you wish to cancel your order, please email your details and order reference to mail@ideas4writers.com. Any order cancellation must be confirmed by email prior to despatch. Once despatched, the returns policy is as set out below.

6.3. So as to comply with the UK Consumer Contracts Regulations, all orders have a 14 Day Cooling-Off Period. The customer is liable for all return shipping costs under this right. Please contact us for advice if you wish to exercise this right.

6.4. Unless confirmed in writing from ideas4writers, all orders must be paid for before delivery. In the event of a custom-made item being ordered, this must be paid for in full prior to delivery. Any shortage of payment will result in the products not being despatched. We reserve the right to charge associated costs incurred. These may include our time, carriage (including aborted deliveries), and for the custom-made product ordered.

6.5. In addition, all returned/exchanged products must be in their original condition. Any damage to the goods or sign of use may result in a reduced refund to the customer. Goods must also be suitably packaged. Customers are advised to obtain and complete a Certificate of Postage form stamped by the Royal Mail before returning item. Responsibility of the goods remains that of the customer until safely received by us. We accept no liability for goods lost or damaged in transit back to us.

6.6. Should an item arrive damaged or defective, the customer must inform ideas4writers in writing within 1 working day of receipt. We will then advise the customer if they are to return the goods for exchange or if we will arrange for the goods to be collected or exchanged via courier.

7.0 CANCELLATIONS AND RETURN

7.1. You have the legal right, under the Consumer Protection (Distance Selling) Regulations 2000 to cancel your order within seven working days. We will process your refund as soon as possible ,in accordance with your legal rights. Your refund will take no more than 30 days.

If you wish to cancel a product you have ordered from us, the following scenarios and the terms apply:

7.2. “I want to cancel the order prior to despatch.”

By law you are permitted to cancel your order prior to despatch. Please contact ideas4writers as soon as possible so that we can minimise the overheads and inconvenience of any costs incurred. This should be via an email sent to mail@ideas4writers.com.

7.3. “I want to cancel a custom-made order.”

Unfortunately, we cannot offer refunds on these items. This is because of the product being made to your specified requirements and tastes,

7.4. “I want to return damaged or incorrectly supplied products.”

Please notify us within 24 hours so that we can organise collection and send you a replacement without charge. You must open and inspect the goods within the allocated time. We do not make any exceptions for this.

7.5. “I have changed my mind on products I’ve received.”

Please inform us within 14 days following the date of receipt, in accordance with the Distance Selling Regulations. You should be advised that ideas4writers cannot accept responsibility or costs for the organisation, collection and return of the products. You are required to take reasonable care of the products and not use them while you organise return delivery. See Customer-organised returns.

8.0. CUSTOMER-ORGANISED RETURNS

8.1. You have the legal right to change your mind and return any products to us. Please be advised that you have a statutory duty to take reasonable care of the products that you are returning. We reserve the right to bring action against you in the event that you breach this statutory duty. This will be reviewed on a case by case basis, but examples include:

8.2. If returned products are lost or damaged in transit, we reserve the right to seek direct costs from you.

8.3. On receipt of the returned goods, we will inspect and assess the suitability of products for re-sale. If returned products are not suitable for resale, we reserve the right to seek payment for the direct cost.

Please note that we will not be responsible for any loss or damage to items in transit. For this reason, we recommend you use a recorded delivery service with appropriate insurance.

9.0. WARRANTIES

9.1. All warranties provided by ideas4writers are done so in addition to your statutory rights.

9.2. Works undertaken during this warranty/guarantee period are not necessarily free of charge and will be subject to the following limitations:

(a) If we deem that a problem was caused by wear and tear or misuse, we may charge for rectification. This also applies in the case of commercial use of a domestic product. We will not make charge if we deem that the problem was due to a manufacturing fault.

(b) Should ideas4writers conclude that the repair is the customer’s responsibility, the customer will in no way hold ideas4writers responsible. Where a customer has a guarantee/warranty issue, we will endeavour to assist wherever practically possible.

(c) We must be allowed the opportunity to view the goods and alleged fault. We will accept photographic evidence or you can return the product, as appropriate.

(d) We accepts no responsibility or liability for products damaged in adverse weather conditions.

10.0. LICENCE

You are permitted to print and download extracts from this website for your own use on the following basis:

(a) No documents or related graphics on this website are modified in any way;

(b) No graphics on this website are used separately from the accompanying text.

11.0. COPYRIGHT

11.1. Unless otherwise stated, the copyright and other intellectual property rights in all material on this website is owned by ideas4writers. This includes, without limitation, the text, photographs, graphical images, video recordings and audio recordings.

Use of extracts from this website, other than in accordance with that stated above, for any purpose is prohibited. If you breach any of the terms in these terms and conditions, your permission to use this website automatically terminates. You must immediately destroy any downloaded or printed extracts from this website.

No part of this website may be reproduced or stored in any other website. Nor may it be included in any public or private electronic retrieval system or service without our prior written permission.

Any rights not expressly granted in these terms are reserved.

We endeavour to ensure that this website is normally available 24 hours a day. However, we will not be liable if this website is unavailable at any time or for any period. Access may be suspended temporarily and without notice in the case of system failure, maintenance, repair, or for reasons beyond our control.

In addition, any assistance given to the delivery driver is done so at the customer’s discretion. This includes helping lift items off the lorry. We accept no responsibility for any injury sustained.

(a) Death or personal injury caused by negligence (as such term is defined by the Unfair Contract Terms Act 1977)

(b) Fraud

(c) Misrepresentation as to a fundamental matter

(d) Any liability which cannot be excluded or limited under applicable law.

15.2. If your use of material on this website results in the need for servicing, repair or correction of equipment, software or data, you assume all costs thereof. You agree to indemnify us fully, defend and hold us and our agents and employees harmless from and against all claims, liability, damages, losses, costs (including reasonable legal fees) arising out of any breach of the terms and conditions by you, or your use of this website, or the use by any other person using your registration details.

16.0. GOVERNING LAW AND JURISDICTION

16.1. These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the English courts.

16.2. We do not warrant that items for sale on this website are appropriate or available for use outside the United Kingdom. It is prohibited to access the website from territories where its contents are illegal or unlawful. If you access this website from locations outside the United Kingdom, you do so at your own risk. You are responsible for compliance with local laws.

17.0. MISCELLANEOUS

You may not assign, sub-license or otherwise transfer any of your rights under these terms and conditions.

If any provision of these terms and conditions is found by any court of competent jurisdiction to be invalid, the invalidity of that provision will not affect the validity of the remaining provisions, which shall continue to have full force and effect.

Only the parties to these terms and conditions may seek to enforce them under the Contracts (Rights of Third Parties) Act 1999.
